Customer Acknowledgment

The customer acknowledges agreement with these Terms and Conditions of Sale by the placement of an order to purchase product from LABERG Pty Ltd. If you do not agree with the stated terms and conditions, LABERG Pty Ltd advises that you do not use the website for any information or purchasing. 

These Terms and Conditions may be amended from time to time at the discretion of LABERG Pty Ltd. 

This contract of sale is between the entity named on the invoice (the “Customer”) and LABERG Pty Ltd. “Goods” refers to the items specified in the invoice which this agreement accompanies.

All goods are supplied on these terms and conditions only and no person in the employment or otherwise as agent for LABERG Pty Ltd has any authority to supply goods on any other terms and conditions or to vary these terms and conditions in any way whatsoever. Previous dealings shall not vary or negate these terms and conditions in any respect.

Ordering 

LABERG Pty Ltd request that all Purchase Orders be faxed or emailed, therefore, no responsibility is taken for errors with any orders placed by telephone. A re-stocking fee or refusal of claim will apply to any errors with telephone orders. 

Warranty Information
A Return Authorisation (RA) number must be issued before returning goods for warranty claims. A Return Authorisation (RA) form must be completed by contacting LABERG Pty Ltd prior to the return of goods. The RA form will be completed and returned to the supplier by LABERG Pty Ltd on your behalf and goods must then be shipped by you directly to the supplier. Goods returned to the supplier without a completed RA form will be rejected and goods returned at the customer’s expense.

You will need to supply the following information which will be on your invoice before we can issue a Return Authorisation Number: 

• Company Name and contact details (as written on your Tax Invoice)

• Name of the product to be returned (as written on your Tax Invoice)

• Date of purchase (as written on your Tax Invoice)

• Reason for return

An inspection fee of $50 (inc GST) will be charged if warranty goods are inspected and no fault found.

Freight and Insurance of returned goods to LABERG Pty Ltd or our supplier are at the customers cost and returned at the customers risk. 

All products sold by LABERG Pty Ltd are covered by the manufacturers’ warranty that accompanies the product. LABERG Pty Ltd makes no additional or independent warranty. LABERG Pty Ltd does not warrant the performance, compatibility, integrity, merchantability and fitness for a particular purpose of any product, but merely passes through to the Customer whatever end-user warranty the manufacturers provide with their respective products. 

Please Note: Due to restrictions placed upon us by the manufacturers, hardware that is defective on arrival can generally be exchanged if we are notified within 7 days of invoice. 

It should be noted that should an item be returned directly to the manufacturer of the product then the duration of the part(s) being under review is beyond the control of LABERG Pty Ltd. 

Goods returned with inadequate packaging or protection CAN void the warranty offered by the manufacturer.


Delivery Of Goods

Shipping of freight is within Australia only. 

Freight charges are calculated on the basis of weight of goods and location of delivery. Freight charges should be checked at the time of placing the order and are the responsibility of the purchaser. 

Delivery will be made to the location specified on the order form and the Customer shall be liable for freight and handling charges. Where an incorrect address has been given to LABERG Pty Ltd with the order, or the freight company is unable to deliver due to repeated absence of anybody to sign for the delivery, we reserve the right to charge for any extra carriage costs incurred.

If the Customer fails or refuses to take delivery of the goods, then in addition to all other rights and remedies of LABERG Pty Ltd, the Customer shall be liable for all loss and damage (including consequential loss and damage) suffered or incurred by LABERG Pty Ltd as a result thereof. LABERG Pty Ltd, at its discretion, may charge a restocking fee of up to 25% of the purchase price. 

LABERG Pty Ltd will endeavour to fill all orders promptly but will not be liable in respect of any delay occurring in the supply of the goods and/or services or any loss or costs the Customer may suffer as a result. Delivery times are estimates only and LABERG Pty Ltd shall not be liable for delays.

The goods shall be at the Customers risk at the point of delivery. The Customer, upon taking delivery of the goods, shall immediately examine the goods and give written notice to LABERG Pty Ltd of any defect or short delivery within seven (7) days of such date, failing which the goods shall be deemed to have been delivered in good order and condition and accepted by the Customer. Claims after this period will be rejected by LABERG Pty Ltd.

Title of Goods

The goods shall remain the sole and absolute property of LABERG Pty Ltd as legal and equitable owner and the Customer shall hold such goods as bailee only until such time as the Customer shall have paid the full price. The Customer shall be liable to LABERG Pty Ltd in respect of any loss or damage to the goods during such bailment. 

Any signatory for a Customer shall be personally liable for the due performance of the Customer’s obligations as if the signatory was the Customer.

Payment

All accounts are strictly PAID IN FULL prior to dispatch, except for approved applicants. 

The normal trading terms of LABERG Pty Ltd are payment by Cheque or Direct Deposit. Please note that your order will not be processed unless the bank transfer reference or cheque is cleared to our account. A bank transfer or cheque order is not confirmed as accepted by us until payment has been received. Any fees incurred by LABERG Pty Ltd due to a cheque not clearing will be the liability of the customer. 

The price shall be paid by the Customer in full without any deduction in respect of any claimed set-off or counterclaim (including any such set-off or counterclaim on account of any delay on the part of LABERG Pty Ltd in delivering any part of the goods) on, before or after the payment date. 

In addition to any other rights or remedies of LABERG Pty Ltd in the event of the Customer’s default hereunder, LABERG Pty Ltd shall be entitled:

a) To charge and recover costs incurred for the collection of payment (such as but not limited to collection agency fees and legal costs), cheque dishonour fees, interest at the current bank rate plus two (2) percent per annum from the due date for payment until payment in full;
b) To immediately and without notice retake possession of the goods (and for such purpose the Customer irrevocably licenses LABERG Pty Ltd, its employees, contractors, servants or agents to enter upon the premises at which the goods are located to so retake possession) and resell the goods after seven (7) days written notice to the Customer and thereafter recover from the Customer any amount by which the resale price is less than the price agreed to be paid by the Customer, together with all costs and expenses suffered or incurred by LABERG Pty Ltd as a result of the Customer’s default;
c) At the sole discretion of LABERG Pty Ltd a restocking fee of up to 25% of the purchase price may be charged.

Errors and Omissions 

Due to the dynamic nature of this industry (EG: vendor price changes and other variables beyond our control), prices, promotions, versions and availability advertised are subject to change without prior notice. Please be assured of our every effort to ensure the accuracy, however the documents and graphics published may contain technical inaccuracies or typographical errors. 

LABERG Pty Ltd makes no representations about the suitability of this information; it is provided “as is” without warranty of any kind. If an error is made or a product is listed at an incorrect price, LABERG Pty Ltd shall maintain the right to refuse or cancel any orders placed. If the order has been confirmed and paid by the Customer, LABERG Pty Ltd shall immediately issue a refund.

Limitation of Liability 

LABERG Pty Ltd shall under no circumstances be liable for special, incidental or consequential damages including loss of profit or opportunity, even if it has been advised of the possibility of such damages. The maximum liability for all direct damages, if any, arising out of any action shall be limited to an amount not to exceed the purchase price of the product.

Pricing & Product Information

All prices indicated are GST inclusive and are subject to change without notice.
Goods are not supplied on a trial basis, please check specification and compatibility with the manufacturer prior to purchasing. 

Although our staff can offer advice, they cannot confirm product compatibility.

All Sales Made In New South Wales, Australia 

All sales shall be deemed made in the state of New South Wales, Australia, regardless of the location of the Customer. The Customer agrees that any dispute with LABERG Pty Ltd shall be brought by the Customer exclusively in the state or federal courts situated in the State of New South Wales.

International

No international orders are accepted for hardware products offered by LABERG Pty Ltd.

External Links 

The LABERG Pty Ltd website may at any time display third party advertisements, embedded and non-embedded hyperlinks, referral buttons and other pointers to Internet Web Sites operated by third parties or their licensees or contractors. LABERG Pty Ltd does not endorse or recommend the products, services or content of the advertisement nor accept any responsibility for the contents of any linked Web Sites or any hyperlink contained within a linked Web Site. Any offer that you can accept by linking to the third party advertiser's Web site and executing the relevant transaction is made by you at your own risk. We respect your privacy. LABERG Pty Ltd collects your details at the time of your order. This information is not disclosed to any third party and is collected by LABERG Pty Ltd. Information is NOT collected at any point while you are browsing our website.

LABERG Pty Ltd warrants that it has good title to all products it sells. 

In the event of any section or portion of a section of these Terms and Conditions of Sale are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms and Conditions of Sale, and the remaining terms shall continue in full force and effect.

We reserve the right to decline any order for any reason.
